The arbitrator's decision shall be final and binding on the parties and may be entered as a judgment in any court of competent jurisdiction. 14.3 Class Action Waiver
YOU AND DAVANNI'S AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a class or representative proceeding or claims.
14.4 Small Claims Court
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes that qualify under the applicable small claims court rules and jurisdictional limits.
15. Term and Termination
